Luvisia Digital understands that your birth certificate serves as a crucial document throughout your life in Kenya. It verifies your identity and is often required for official procedures. However, there may come a time when you wish to change the name on your birth certificate. Perhaps it doesn’t reflect your preferred name, the name deviates from other documents, or there’s a need for legal correction. Whatever the reason, understanding the process can ensure a smooth transition.
Who Can Change Their Name?
The Kenyan legal framework allows name changes for various individuals:
Children under two years old
Parents or guardians can apply for a name change within six months of birth registration by visiting the Registrar of Births and Deaths. This is a simple process requiring minimal paperwork.
Children between two and eighteen years
Parents or guardians can apply through the Registrar of Births and Deaths within two years of the initial registration. However, if this window is missed, a more complex procedure involving a Deed Poll becomes necessary.
Adults (eighteen and above)
Adults can change their names at any time using a Deed Poll.
The Deed Poll Process
A Deed Poll is a legal document declaring your intention to change your name.
Obtain a Deed Poll form: You can acquire this form from the Registrar General’s Department or download it online from reputable legal resource websites.
- Complete the form: Fill out the form accurately, providing details like your current name, desired new name, and reason for the change.
- Gather supporting documents: These may include:
- Certified copy of your birth certificate
- Kenyan National Identification Card (ID)
- Marriage certificate (if applicable)
- Divorce decree (if applicable)
- School leaving certificates (optional)
- Sworn affidavit from a witness who has known you for at least ten years (optional)
- Witness your signature: Have the form witnessed by a Commissioner for Oaths or a person authorized to administer oaths in Kenya.
- Submit the documents: Present the completed Deed Poll form and supporting documents to the Registrar of Documents at the Attorney General’s Office.
- Pay the prescribed fee: There’s a government fee associated with processing the Deed Poll. The current fee can be confirmed at the Registrar of Documents office.
- Newspaper publication: Once your Deed Poll is registered, the Registrar will advertise it in the Kenya Gazette, a government newspaper.
Timeline and Considerations
The processing time for a Deed Poll can vary depending on workload. However, it typically takes several weeks. Keep in mind that missing documents or errors in the application can cause delays.
Note!
- Reason for change: While not always mandatory, stating a clear reason for the name change can expedite the process.
- Legal advice: For complex situations or if you have concerns, consider consulting a lawyer specializing in name change procedures.
- Updating other documents: Once your birth certificate is updated, remember to change your name on other essential documents like your ID card, passport, bank accounts, etc.
